Plain English Summary
Third Place is a local social discovery app. These Terms are the agreement between you and us. By creating an account, you agree to them. You must be 18 or older to use the app. Be respectful, be safe, and take responsibility for the real-world connections you make.
By accessing or using the Third Place application at thirdplac.com ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms form a legally binding agreement between you and Philiph John, operating as a sole trader under the trading name Third Place ("we", "us", "our"), governed by the laws of Queensland, Australia.
When you create an account, you will be asked to confirm you have read and accepted these Terms and our Privacy Policy via a checkbox. That confirmation constitutes your consent.

You must be at least 18 years of age to create an account or use Third Place. By registering, you represent and warrant that you meet this requirement.
The App facilitates in-person social interactions between strangers. It is not designed for, and must not be used by, anyone under 18. If we become aware that a user is under 18, we will suspend or delete their account immediately.
You must also have the legal capacity to enter into a binding agreement under Australian law. If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@thirdplac.com if you suspect unauthorised use of your account.
You must provide accurate and truthful information when creating your profile. Using a false identity, impersonating another person, or misrepresenting your age is a breach of these Terms and may result in immediate account termination.
One account per person. You may not create multiple accounts to evade a ban or restriction.
You may delete your account at any time by contacting us. We will remove your personal data in accordance with our Privacy Policy.
Third Place exists to help people build genuine local connections. We expect all users to treat each other with respect. You agree not to use the App to:
- Harass, threaten, stalk, intimidate, or harm any other user or person
- Share sexually explicit, violent, or otherwise offensive content
- Solicit money, goods, or services from other users
- Promote or facilitate any illegal activity
- Send unsolicited commercial messages or spam
- Scrape, harvest, or otherwise collect data about other users without consent
- Attempt to gain unauthorised access to the App, its servers, or other users' accounts
- Post content that infringes the intellectual property rights of any third party
- Misrepresent your identity, age, or intentions to another user
- Use the App in any way that violates applicable Australian law
We reserve the right to remove any content and suspend or terminate any account that breaches these guidelines, at our sole discretion and without prior notice.
You are solely responsible for any content you post, upload, or transmit through the App, including your profile, messages, captions, and event listings ("User Content").
By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, display, and distribute that content solely for the purpose of operating and improving the Service. You retain ownership of your content.
We do not pre-screen User Content and are not responsible for content posted by other users. If you encounter content that violates these Terms, please report it to hello@thirdplac.com.
Third Place is a platform, not a publisher. We are not liable for User Content under the applicable provisions of Australian law.
The App uses your device's GPS to enable location-based features (live map, snaps, nearby discovery). Location access is opt-in — you choose when to share your location by posting a snap. The App does not track your location in the background.
When you post a snap, your approximate location is visible to other users of the App for the duration of that snap (approximately 3 hours). By posting a snap, you consent to this temporary disclosure.
You can withdraw location consent at any time by not posting a snap or revoking location permission in your device settings. Full details are in our Privacy Policy.
Third Place facilitates connections between real people in real places. You use the App and meet other users entirely at your own risk.
We do not conduct background checks on users. We cannot verify that any user is who they say they are. You should exercise the same caution you would in any real-world encounter with a stranger.
Safety Reminder
Meet in public places. Tell someone where you're going. Trust your instincts. If a situation feels unsafe, leave. If you believe you are in danger, contact emergency services (000 in Australia).
We are not responsible for the conduct of any user in person or online. Any interaction you have with another user — online or in real life — is between you and that user. We are not a party to those interactions.
The Third Place name, logo, design, code, and all original content produced by us are owned by Philiph John trading as Third Place and are protected by Australian copyright and intellectual property law. You may not reproduce, distribute, or create derivative works from any of our property without written permission.
The App uses third-party services including Google Places API, Supabase, and Leaflet.js. Those services are subject to their own terms and licences.
Third Place relies on third-party infrastructure to operate, including:
- Supabase Inc. (United States) — database and authentication. Your data is stored on Supabase servers. See their Privacy Policy.
- Google LLC (United States) — Places API for venue data. See Google's Privacy Policy.
- Netlify Inc. (United States) — web hosting. See their Privacy Policy.
By using Third Place, you acknowledge that your data may be processed by these third-party providers outside of Australia. We take reasonable steps to ensure these providers maintain adequate data protection standards.
We are not responsible for the content, availability, or practices of any third-party service linked to or used within the App.
To the maximum extent permitted by Australian law, Third Place and Philiph John are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
- Loss of data, revenue, or profits
- Harm arising from interactions with other users, online or in person
- Service interruptions, bugs, or security breaches
- Reliance on any information provided through the App
Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) or any other non-excludable statutory guarantee.
Our total liability to you for any claim arising out of or in connection with these Terms or your use of the App will not exceed the amount you have paid us in the 12 months preceding the claim (which, for a free service, may be nil).
You agree to indemnify and hold harmless Philiph John (trading as Third Place), and any of our contractors or partners, from any claims, losses, damages, liabilities, or expenses (including reasonable legal fees) arising from:
- Your use of the App in violation of these Terms
- Your User Content
- Your interactions with other users, online or in person
- Any breach of applicable law by you
We may suspend or terminate your account at any time, with or without notice, if we believe you have breached these Terms or if we decide to discontinue the Service.
You may stop using the App and request account deletion at any time by contacting hello@thirdplac.com.
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) will continue to apply.
We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
For significant changes, we will make reasonable efforts to notify you via the App or the email address on your account.
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Queensland.
Before commencing formal proceedings, we encourage you to contact us at hello@thirdplac.com to attempt to resolve the matter informally. Most disputes can be resolved quickly through direct communication.
Nothing in this clause limits your right to contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au for privacy-related complaints.
